Summary
We recognise that terms and conditions are not always the most enjoyable, or easiest of things to read, but they are important and you should read the full terms and conditions in detail before accepting them.
Here are some brief highlights about what is included:
- That you must comply with these terms and conditions, which include our Acceptable Use Policy and our Privacy & Cookies Policy.
- That access to the API Service is via a paid monthly subscription (although we may also offer you a free trial before your first payment is taken).
- That we offer different subscription levels and each provides access to different functionality, including a quota for the number of API queries you can make each month. Each subscription level has a different fee.
- That you agree that we can initiate a payment each month for the cost of each subscription. Payments are processed via our Payment Provider (Stripe) and we will share some of your details with them for the purpose of processing payments.
- That you can develop an integration with our API Service (so long as you’ve created an account and your subscription payments are up to date).
- That you must not misuse our Website or API Service, must not scrape our Website or API Service and must not cache the API Service data that you’re not allowed to.
- That our API Service is provided as an advisory service and we don’t provide any warranty for the accuracy of the data or search responses. We also don’t provide any guarantee of service availability.
- That we and our licensors own the data. We own the copyright and Intellectual Property rights of this site and API Service (including any trademarks, logos and names).
- That we use cookies; we also provide details about how we store and process your data.
Terms and conditions of use
References in these terms and conditions to "you" are to any individual user (or, if used for a business purpose or organisational project, the person, company or other legal entity that operates that business or organisational project), of the Website and/or of the API Service (and "your" should be construed accordingly); references in these terms and conditions to "us" are to My Buggy My Car Limited, a company registered in England and Wales with company number 11511022 having its registered office at 4a, 1 Water Lane, Totton, Southampton SO40 3DP (and "we" and "our" should be construed accordingly).
- Definitions
- In these terms and conditions, except to the extent expressly provided otherwise:
- "Access Credentials" means the usernames, passwords and other credentials enabling access to the API Service;
- "API Service" means the application programming interface defined by us and made available by us to you;
- "Business Day" means any weekday other than a bank or public holiday in England;
- "Business Hours" means the hours of 09:00 to 17:00 GMT/BST on a Business Day;
- "Fees" means any subscription fees or other charges payable by you in respect of the API Service;
- "Force Majeure Event" means an event, or a series of related events, that is outside our reasonable control (including failures of the internet or any public telecommunications network, hacker attacks, denial of service attacks, virus or other malicious software attacks or infections, power failures, industrial disputes affecting any third party, changes to the law, epidemics or pandemics, disasters, explosions, fires, floods, riots, terrorist attacks and wars);
- "Intellectual Property Rights" means all intellectual property rights wherever in the world, whether registrable or unregistrable, registered or unregistered, including any application or right of application for such rights (and these "intellectual property rights" include copyright and related rights, database rights, confidential information, trade secrets, know-how, business names, trade names, trade marks, service marks, passing off rights, unfair competition rights, patents, petty patents, utility models, semi-conductor topography rights and rights in designs);
- “Quota” has the meaning set out in Section 10.4;
- “Subscription Plan” means a package of API Service features, including a Quota of searches to which you subscribe after opening an account on our Website; and
- "Website" means this website.
- In these terms and conditions, except to the extent expressly provided otherwise:
- Introduction
- These terms and conditions shall govern your use of our Website and any API Service to which you subscribe.
- You must comply with the Acceptable Use Policy at Schedule 1, which is incorporated by reference into these terms and conditions.
- Our Privacy and Cookies Policy, which explains how we will handle your personal data as a user of our Website and/or the API Service, can be found at Schedule 2.
- By using our Website or API Service, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, including the Acceptable Use Policy at Schedule 1, you must not use our Website or API Service.
- If you register with our Website or subscribe to the API Service, we will ask you to expressly agree to these terms and conditions.
- You must be at least 18 years of age to register on our Website or use the API Service; by registering on our Website or subscribing to the API Service, you warrant and represent to us that you are at least 18 years of age.
- Our API Service is advisory and, subject to Sections 14 and 15, we do not warrant for accuracy or availability of the data or search responses provided by the API Service.

- Nothing in these terms and conditions shall operate to assign or transfer any Intellectual Property Rights from us to you, or from you to us.
- Permission to Use Website and API Service
- You may:
- view pages from our Website in a web browser;
- download pages from our Website for caching in a web browser;
- print pages from our Website for your own personal and non-commercial use, providing that such printing is not systematic or excessive;
- access the API Service; and
- develop a system-to-system integration to the API Service.
- Except as expressly permitted by Section 1 or the other provisions of these terms and conditions, you must not download any material from our Website or save any such material to your computer.
- Except as expressly permitted by these terms and conditions, you must not edit or otherwise modify any material on our Website.
- You may only use our Website or API Service for your own personal and business purposes; you must not use our Website or API Service for any other purposes.
- Developer documentation with sample code is made available to API Service subscribers. You can use this documentation to aid your understanding of the API Service and build any custom integrations you may require. For the avoidance of doubt, it is your responsibility to arrange the development of any integration and we are unable to provide material support for your developments.
- When you subscribe to the API Service, we will provide you with the Access Credentials necessary for you to access and use the API Service by means of web-connected system or web browser, limited to the capabilities provided in respect of your Subscription Plan. In doing so we grant to you a non-exclusive licence to use the API Service for your own personal and business purposes.
- Except to the extent expressly permitted in these terms and conditions or required by law on a non-excludable basis, the licence granted by us to you under Section 2 is subject to the following limitations:
- the API Service may only be used through a web-connected system capable of consuming our data;
- the API Service may only be used by you, using the Access Credentials granted to you upon payment of the Fees and for as long as you remain a subscriber to the API Service; and
- the API Service may only be used by an application or applications controlled by you.
- you must not sub-license your right to access and use the API Service;
- you must not permit any unauthorised person or application to access or use the API Service;
- you must not attempt to reverse engineer or copy our Website or API Service for any purpose, including that of creating a competing product or similar service;
- you must not conduct or request that any other person conduct any load testing or penetration testing on the API Service without our prior written consent; and
- You shall implement and maintain reasonable security measures relating to the Access Credentials to ensure that no unauthorised person or application may gain access to the API Service by means of the Access Credentials.
- We shall use all reasonable endeavours to maintain the availability of the API Service to you at the gateway between the public internet and the network of our hosting services provider for the API Service, but do not guarantee 100% availability.
- You must not cache any data or messages returned as part of a valid search query against the API Service.
- For the avoidance of doubt, downtime caused directly or indirectly by any of the following shall not be considered a breach of these terms and conditions:
- a Force Majeure Event;
- a fault or failure of the internet or any public telecommunications network;
- a fault or failure of your computer systems or networks;
- any breach by you of these terms and conditions; or
- scheduled maintenance carried out in accordance with these terms and conditions.
- For the avoidance of doubt, you have no right to access the software code (including object code, intermediate code and source code) of our Website and API Service, either before, during or after the term of your subscription.
- You may:
- Misuse of Website and API Service
- You must not:
- use our Website or API Service in any way or take any action that causes, or may cause, damage to the Website or API Service or impairment of the performance, availability, accessibility, integrity or security of the Website or API Service;
- use our Website or API Service in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
- hack or otherwise tamper with our Website or API Service;
- probe, scan or test the vulnerability of our Website or API Service without our permission;
- circumvent any authentication or security systems or processes on or relating to our Website or API Service;
- use our Website or API Service to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
- impose an unreasonably large load on our Website or API Service resources (including bandwidth, storage capacity and processing capacity);
- decrypt or decipher any communications sent by or to our Website or API Service without our permission;
- conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our Website or API Service without our express written consent;
- access or otherwise interact with our Website or API Service using any robot, spider or other automated means;
- use our Website or API Service except by means of our public interfaces;
- attempt to reverse engineer or copy our Website or API Service for any purpose, including that of creating a competing product or similar service;
- violate the directives set out in the robots.txt file for our Website or API Service;
- use data collected from our Website or API Service for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing); or
- do anything that interferes with the normal use of our Website or API Service.
- You must not use data collected from our Website or API Service to contact individuals, companies or other persons or entities.
- You must ensure that all the information you supply to us through our Website or API Service, or in relation to our Website or API Service, is true, accurate, current, complete and non-misleading.
- Unless you own or control the relevant rights in the material, you must not:
- republish material from our Website or API Service (including republication on another Website) except for any allowable information included in a valid API response;
- publish, republish or pass on any unique identifier that is returned by an API Service search that identifies a particular vehicle or buggy;
- sell, rent or sub-license material from our Website or API Service;
- show any material from our Website or API Service in public except for allowable information included in a valid API response;
- exploit material from our Website for a commercial purpose; or
- redistribute material from our Website.
- Notwithstanding Section 4, you may redistribute our newsletter in print and electronic form to any person.
- In the event that your subscription provides third-party affiliated links, you must not try to bypass or replace our affiliate identification. For clarity, “affiliated” links contain our unique identifier that allows the third party to identify us for the purpose of sales tracking and awarding of commission payments. You must not replace the affiliate identifier or otherwise prevent the third party from identifying us.
- You must not:
- Availability and Scheduled Maintenance
- We reserve the right to suspend or restrict access to our Website, to areas of our Website and/or to functionality upon our Website. We may, for example, suspend access to the Website during server maintenance or when we update the Website, or rate limit your access if, in our sole discretion, it imposes an unreasonably large load on our Website or server resources. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the Website.
- We may from time to time suspend the API Service for the purposes of scheduled maintenance, providing that such scheduled maintenance must be carried out in accordance with this Section 6.
- We shall make our best efforts to ensure that all scheduled maintenance on the API Service is carried out outside Business Hours.
- Use on Behalf of an Organisation
- If you use our Website or API Service or expressly agree to these terms and conditions in the course of a business or other organisational project, then by so doing you bind both:
- yourself; and
- the person, company or other legal entity that operates that business or organisational project,

- Registration and Accounts
- To be eligible for an account on our Website under this Section 8, you must be resident or situated in the United Kingdom.
- You may register for an account with our Website by completing and submitting the account registration form on our Website and clicking on the verification link in the email that the Website will send to you.
- You must not allow any other person to use your account to access the Website, or use any other person’s account to access the Website, unless you have been issued a shared set of credentials for access by your organisation.
- You must notify us in writing immediately if you become aware of any unauthorised use of your account.
- User Login Details
- If you register for an account with our Website, you will be asked to choose a user ID and password.
- Your user ID must not be liable to mislead and must comply with the content rules set out in the Acceptable Use Policy; you must not use your account or user ID for or in connection with the impersonation of any person.
- To become a subscriber to our API Service, you must pay the applicable Fees for your chosen Subscription Plan after you have registered for an account with our Website. We will send you an acknowledgment of your order, and provide access to your API Access Credentials, to allow you to access the API Service.
- You must keep your password and Access Credentials confidential.
- If you become aware of any disclosure of your password and Access Credentials, you must immediately (a) notify us in writing and (b) change your password using our Website, or follow our instructions regarding using the issue of new Access Credentials.
- You are responsible for any activity on our Website arising out of any failure to keep your password or Access Credentials confidential and may be held liable for any losses arising out of such a failure.
- Subscriptions
- You may be offered a free trial period under your Subscription Plan. In order to benefit from such a trial period, you will still have to submit payment details and will be automatically billed for your chosen Subscription Plan when the trial period ends, unless you cancel using the cancellation facility on our Website before the end date of the free trial period.
- For so long as your account and Subscription Plan remain active in accordance with these terms and conditions, you will benefit from the API Service features specified on our Website in relation to your Subscription Plan.
- Your Subscription Plan will specify the number of API Service searches you can undertake in a month (your “Quota”). We may, in our sole discretion, allow you to exceed this number on an occasional basis, but in the event that we do not do so then your access to the API Service will be restricted until the beginning of the next month unless you upgrade to a Subscription Plan that allows a higher Quota.
- If you submit an API Service search and we are unable to provide you with a legitimate response, then this will not count against your Quota.
- In the event that you upgrade to a Subscription Plan that allows a higher Quota, you will be charged immediately a pro-rated amount for the delta between your current Subscription Plan and the new Subscription Plan and you will be able to access new plan immediately. If you downgrade to a Subscription Plan with a lower Quota, you will not be reimbursed for any prepaid Fees but you will retain access to your current Subscription Plan until the end of your then-current subscription period.
- We may from time to time vary the benefits associated with a Subscription Plan by giving you written notice of the variation, providing that, if in our reasonable opinion such a variation results in a substantial loss of value or functionality, you shall have the right to cancel your subscription using the cancellation facility on our Website, and we will refund to you any Fees paid to us in respect of any period of subscription after the date of such cancellation.
- At the end of any period of subscription for which you have paid, and subject to the other provisions of these terms and conditions, your subscription will be automatically renewed and you must pay to us the then-applicable Fees (which our payment provider will attempt to collect automatically via your stored payment method), unless you cancel the subscription using the cancellation facility on our Website before the date of renewal.
- Cancellation and Suspension of Account
- We may:
- edit your account details to the degree necessary to maintain their accuracy;
- temporarily suspend your account and/or Access Credentials; and/or
- cancel your account and revoke your Access Credentials,
- We may suspend the provision of the API Service if any Fees due to be paid by you to us under these terms and conditions or the terms of your subscription are overdue.
- You may cancel your account on our Website using your account control panel on the Website. You will not be entitled to any refund of Fees if you cancel your account in accordance with this Section 2.
- We may:
- Fees
- The Fees in respect of our API Service will be as set out on the Website from time to time.
- All amounts stated in these terms and conditions or on our Website are stated inclusive of VAT.
- You must pay to us the Fees in respect of our API Service in advance, in cleared funds, in accordance with any instructions on our Website.
- We may vary Fees from time to time by posting new Fees on our Website, but this will not affect Fees for services that have been previously paid.
- If you dispute any payment made to us, you must contact us immediately and provide full details of your claim.
- If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay us, within 7 days following the date of our written request:
- an amount equal to the amount of the charge-back;
- all third party expenses incurred by us in relation to the charge-back (including charges made by our or your bank or payment processor or card issuer);
- an administration fee of GBP 25.00 including VAT; and
- all our reasonable costs, losses and expenses incurred in recovering the amounts referred to in this Section 10.6 (including without limitation legal fees and debt collection fees),
- If you owe us any amount under or relating to these terms and conditions, we may suspend or withdraw the provision of services to you.
- We may at any time set off any amount that you owe to us against any amount that we owe to you, by sending you written notice of the set-off.
- Report Abuse
- If you learn of any unlawful material or activity on our Website, or any material or activity that breaches these terms and conditions, please let us know.

- Limited Warranties
- We do not warrant or represent:
- the completeness or accuracy of the information published on our Website or via our API Service;
- that the material on the Website is up to date;
- that the Website or the API Service will operate without fault; or
- that the Website or the API Service will remain available.
- We reserve the right to discontinue or alter any or all of our API Service, and to stop publishing our Website, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of our API Service, or if we stop publishing the Website, other than a refund of any prepaid Fees relating to the period after any discontinuation of the provision of the API Services.
- To the maximum extent permitted by applicable law and subject to Section 15.1, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our Website and API Service and the use of our Website and API Service.
- We do not warrant or represent:
- Limitations and Exclusions of Liability
- Nothing in these terms and conditions will:
- limit or exclude any liability for death or personal injury resulting from negligence;
- limit or exclude any liability for fraud or fraudulent misrepresentation;
- limit any liabilities in any way that is not permitted under applicable law; or
- exclude any liabilities that may not be excluded under applicable law.
- The limitations and exclusions of liability set out in this Section 15 and elsewhere in these terms and conditions:
- are subject to Section 1; and
- govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
- We shall not be liable to you in respect of any losses arising out of a Force Majeure Event.
- To the extent that our Website and the information and services on our Website are provided free of charge, we will not be liable for any loss or damage of any nature.
- We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
- We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
- We will not be liable to you in respect of any inaccurate data returned by the API Service.
- We will not be liable to you in respect of any loss or corruption of any data, database or software.
- We will not be liable to you in respect of any special, indirect or consequential loss or damage.
- You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the Website, the API Service or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).
- Our aggregate liability to you in respect of any contract to provide services to you under these terms and conditions shall not exceed the greater of:
- £75; and
- the total amount paid and payable by you to us under these terms and conditions in the month preceding the event or events giving rise to the liability.
- Nothing in these terms and conditions will:
- Indemnity
- You hereby indemnify us, and undertake to keep us indemnified, against any and all losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute) incurred or suffered by us and arising directly or indirectly out of your use of our Website or the API Service or any breach by you of any provision of these terms and conditions.
- Force Majeure Event
- If a Force Majeure Event results in our failure or delay in performing any obligation under these terms and conditions, that obligation will be suspended for the duration of the Force Majeure Event.
- If we become aware of a Force Majeure Event which gives rise to, or which is likely to give rise to, any failure or delay in us performing any obligation under these terms and conditions, we will:
- promptly notify you;
- inform you of the period for which it is estimated that such failure or delay will continue; and
- take reasonable steps to mitigate the effects of the Force Majeure Event.
- Breaches of These Terms and Conditions
- Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
- send you one or more formal warnings;
- temporarily suspend your access to our Website and/or the API Service;
- permanently prohibit you from accessing our Website and/or the API Service;
- block computers using your IP address from accessing our Website and/or the API Service;
- contact any or all of your internet service providers and request that they block your access to our Website and/or the API Service;
- commence legal action against you, whether for breach of contract or otherwise; and/or
- suspend or delete your account on our Website and/or the API Service.
- Where we suspend or prohibit or block your access to our Website or the API Service or a part thereof, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account).
- Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
- Third Party Websites
- Our Website includes hyperlinks to other websites owned and operated by third parties; such hyperlinks are not recommendations.
- We have no control over third party websites and their contents, and subject to Section 1 we accept no responsibility for them or for any loss or damage that may arise from your use of them.
- Trade marks
- My Buggy My Car name, our typography, our logos and our other registered and unregistered trade marks are trade marks belonging to us; we give no permission for the use of these trade marks, and such use may constitute an infringement of our rights.
- Any third party registered and unregistered trade marks or service marks on our Website or in the API Service are the property of their respective owners and, unless stated otherwise in these terms and conditions, we do not endorse and are not affiliated with any of the holders of any such rights and as such we cannot grant any licence to exercise such rights.
- Variation
- We may revise these terms and conditions from time to time.
- We will give you written notice via email (sent to the email address registered to your account) of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of our Website and API Service from the date that we give you such notice; if you do not agree to the revised terms and conditions, you must stop using our Website and API Service.
- Assignment
- You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
- You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
- Severability
- If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
- If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
- Third Party Rights
- A contract under these terms and conditions is for our benefit and your benefit and is not intended to benefit or be enforceable by any third party.
- The exercise of the parties' rights under a contract under these terms and conditions is not subject to the consent of any third party.
- Entire Agreement
- These terms and conditions, together with our privacy and cookies policy, shall constitute the entire agreement between you and us in relation to your use of our Website and the API Service and shall supersede all previous agreements between you and us in relation to your use of our Website and the API Service.
- Law and Jurisdiction
- These terms and conditions shall be governed by and construed in accordance with English law.
- Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
- Statutory and Regulatory Disclosures
- We will not file a copy of these terms and conditions specifically in relation to each user or customer and, if we update these terms and conditions, the version to which you originally agreed will no longer be available on our Website. We recommend that you consider saving a copy of these terms and conditions for future reference.

- Introduction

- You must not use the Website or the API Service in any way that causes, or may cause, damage to the Website or API Service or impairment of the availability or accessibility of the Website or API Service.
- You must not use the Website or the API Service:

- in connection with any unlawful, illegal, fraudulent, deceptive or harmful purpose or activity.
- You must ensure that all Content complies with the provisions of this Policy.
- Unlawful Content
- Content must not be illegal or unlawful, must not infringe any person's legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).
